The EFF has won legal protections that make jailbreaking your phone legal:

This is a huge stride for people rights and stopping the broad overreach of the Digital Millennium Copyright Act.
I am hoping this will also pertain to devices such as the routers, game consoles, dvrs ... etc where people have put their own firmware or operating system and have been threatened with legal action.
